This policy shall be the guiding principles in the determination of available leave in Saint Columban College.
This policy is intended for the determination of allowable leave of absence for Saint Columban College employees.
This policy shall be applicable to all employees of Saint Columban College unless there is a specific applicability. There shall be no presumption of inclusion not unless mentioned otherwise.
Every employer within his/her means and subject to his/her limitations must endeavor to give his/her employees an ideal economic package to ensure a healthier, happier and more efficient workforce. Saint Columban College, in full awareness of its legal and moral obligation to employees, provides the following benefits:
The school grants paid sick leave with a maximum of five (5) days for common sickness (e.g. headache, stomachache, toothache, LBM, sore eyes, dysmenorrhea, hypertension, severe cough and colds, and others) as endorsed by the Health Services Office to the Human Resource Development Office. The school also grants a maximum of ten (10) days for sickness that needs hospitalization on top of the 5 days paid sick leave for common sickness. The employee must inform the HSO and the immediate unit head of the present medical condition. Upon his/her return, he/she shall file leave of absence.
5.1. To be entitled to the Sick Leave, the employee must inform the Head of Office and the HSO and present a medical certificate issued by the School Physician or the attending physician after hospital confinement. Absences without the medical certificate shall be automatically charged against the 5-day service incentive leave provided by the law, an excess number of days absent will be charged against the employee's salary.
5.2. When an employee suffers from a disease and his/her continued employment is prohibited by law or prejudicial to his/her health or the health of others in the academic community, his/her employment shall not be terminated unless there is a certification from his/her physician or any competent public health authority that the disease is of such nature and of such stage that it cannot be cured within six (6) months even with proper medication. If the disease or ailment can be cured within the period, the employee shall not be terminated but shall go on Leave Without Pay (EXTENDED LEAVE). Upon restoration of his/her normal health as certified by a physician, the employee shall be immediately reinstated to his/her former position.
5.3. If the disease cannot be cured during the extended leave of six months, he/she shall be separated from service, with the benefit of a separation pay equivalent to at least one-month salary or one-half-month salary for every year of service, whichever is greater, a fraction of at least six months being considered as one year. (Labor Code Article 284)
An SSS member can be granted sickness benefit for a maximum of one hundred twenty (120) days in one calendar year. Any unused portion of the allowable 120 days sickness benefit cannot be carried forward and added to the total number of allowed compensable days for the following year.
6.1. The sickness benefit shall not be paid more than 240 days on account of the same illness. If the sickness or injury still persists after 240 days, his/her claim will be considered a disability claim.
6.2. The sickness benefit can be availed of only if he/she filed for a leave of absence without pay from the school.
Every full-time employee who has rendered at least one year of service shall be entitled to a yearly SIL of five (5) days with pay.
7.1. Probationary Faculty member given a contract of one school year in Elementary or High School, or two semesters in college and Senior High School, shall enjoy a 5-day incentive leave with pay, provided he/she has rendered at least one year of service. The unused service incentive leave is commutable to its money equivalent at the end of the year. In computing, the basis shall be the salary rate at the date of commutation.
7.2. Staff shall be entitled to service incentive leave with pay of 5 days after one year of service.
Every full-time staff who has rendered at least one year of service can avail of the vacation leave under the following conditions:
8.1. A full-time staff can avail of a 10-day paid vacation leave;
8.2. The first 5 days of the vacation leave can be availed at any time within the fiscal year upon the approval of leave;
8.3. The remaining days shall be availed during the Christmas vacation: December 24-January 1.
Emergency leave are given to all employees of SCC regardless of employment status to enable them to cope with certain events in life. There shall be a maximum of ten (10) emergency leave with pay every school year and shall be utilized on either of the following types of emergency occurrence subject for approval:
9.1. Bereavement Leave. In case of death of an employee's family member or an acquaintance.
9.2. Fortuitous Event. In cases of fortuitous events which can prevent the employee from reporting to work, a leave with pay shall be extended to him/her.
9.3. Marriage. The institution grants to an employee who will get married or desires to attend a matrimonial ceremony a leave with pay.
9.4. Family/Self-Care Leave. In case of illness of a family member or for the employee's wellness, an employee shall be entitled to a Family/Self-Care leave with pay.
9.5. Ordination/Religious Profession. The institution grants to an employee who desires to attend engagements related to Catholic religious events a leave with pay.
All covered female workers in government and the private sector, including those in the informal economy, regardless of civil status or the legitimacy of her child, shall be granted one hundred five (105) days maternity leave with full pay and an option to extend for an additional thirty (30) days without pay: Provided, That in case the worker qualifies as a solo parent under Republic Act No. 8972, or the "Solo Parents' Welfare Act", the worker shall be granted an additional fifteen (15) days maternity leave with full pay.
10.1. Enjoyment of maternity leave cannot be deferred but should be availed of either before or after the actual period of delivery in a continuous and uninterrupted manner, not exceeding one hundred five (105) days, as the case may be.
10.2. Maternity leave shall be granted to female workers in every instance of pregnancy, miscarriage or emergency termination of pregnancy, regardless of frequency. Provided, that for cases of miscarriage or emergency termination of pregnancy, sixty (60) days maternity leave with full pay shall be granted.
Male employees of SCC shall be entitled to a paternity leave with pay not to exceed seven (7) working days for the first four deliveries of his legitimate spouse.
